Terms and Conditions

SocietySpeaks.io ("we", "us", or "our") is operated by Kelmoss Ltd, a company incorporated in England (company number 15629688) with its registered office at 124 City Road, London, EC1V 2NX. Our platform provides community discussion and collective intelligence gathering. The platform is hosted on infrastructure in the United Kingdom and the European Economic Area, as described in our Privacy Policy. By using the Website, you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree with these Terms, you must not use the website.

1. Definitions

  • "Platform" means the SocietySpeaks.io website and all related services
  • "Discussion Platform" means the discussion and collective intelligence features of SocietySpeaks.io
  • "Service" means all services provided through SocietySpeaks.io
  • "User", "you", or "your" means any person accessing or using the Platform
  • "Content" means any information, text, comments, votes, or other materials submitted to or generated through the Platform
  • "Discussion Data" means comments, votes, and interaction patterns within discussions
  • "Subscription" means any paid access to premium features of the Platform

2. Discussion Platform Use

2.1 Our platform enables community discussions and collective intelligence gathering. By participating in discussions, you acknowledge and agree that:

  • Your contributions will be publicly visible to other users
  • Your voting patterns contribute to collective analysis
  • Comments and votes cannot be retroactively removed from group analysis
  • Discussion data may be used to generate insights and patterns

2.2 When participating in discussions, you agree not to:

  • Post harmful, offensive, or inappropriate content
  • Attempt to manipulate or game the discussion system
  • Use automated means to submit comments or votes
  • Harass or intimidate other participants
  • Share misleading or false information

3. Registration and Account

3.1 Eligibility: You must be at least 16 years old to register for an account.

3.2 Account Information: You agree to provide accurate and complete information when creating an account and to keep this information up-to-date.

3.3 Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Intellectual Property

4.1 Our Intellectual Property: The platform, including all software, designs, text, and graphics, is owned by Kelmoss Ltd or our licensors.

4.2 Your Content: While you retain ownership of content you create, by submitting content to discussions you grant us and other users the right to view, analyse, and interact with that content as part of the collective discussion process.

5. Donations and Payments

5.1 Platform Support: SocietySpeaks.io is supported by donations from our community. Your contributions help us maintain and improve the platform for everyone.

5.2 Supporting the Platform: You can support us in two ways:

  • One-time donations to help cover platform costs
  • Monthly or annual subscriptions

5.3 Payment Processing:

  • All financial transactions are processed securely through Stripe
  • Payments are processed in Great British Pounds (GBP)
  • Subscriptions automatically renew unless cancelled

5.4 Subscription Terms:

  • You can cancel your subscription at any time through your account settings
  • Cancellation will take effect at the end of your current billing period

5.5 Taxes and Fees: All displayed amounts exclude VAT and any applicable taxes. You are responsible for any applicable taxes or fees.

5.6 Consultations: A verified email may run consultations free for 14 days from the first one taken live, once. Another person at the same organisation may start their own trial. The consultation closes when that access ends, and the report stays available to the account afterwards. A 30-day pass is paid for once and covers every consultation one organisation takes live in the 30 days after payment. A pass bought during the trial starts when the trial ends. A further payment taken while a pass is still open starts when that pass ends. If the earlier pass is refunded before it is used, the later one starts straight away and stays 30 days long. A further pass can be bought only in the last seven days of the open one. Each consultation is one question, one audience and one report. If you have paid for a pass and no consultation has been open on it, you can have it refunded in full from your account at any time. Once a consultation is open on that pass, whether it was taken live on it or was already open when the pass began, the pass is not refundable. A pass that has been taken off the annual plan is not refundable. The annual consultation plan covers an unlimited number of consultations run by one organisation with its own audiences (for example its members, staff, customers, readers or event attendees) for the year. Neither a pass nor the annual plan covers running consultations for, or on behalf of, other organisations or clients, and neither may be resold or shared between organisations. If the annual plan is started while a 30-day pass is still open, the amount paid for that pass is taken off the first year. The annual plan renews each year until cancelled; you can cancel at any time and keep access until the end of the period you have paid for. We may suspend a plan or a pass that is used outside these terms.

6. Data Processing

6.1 Platform Infrastructure: Our service operates on the following infrastructure:

  • Render - Application hosting (Frankfurt, Germany)
  • Neon - Primary database (London, United Kingdom)
  • Amazon Web Services - File storage and backups (London, United Kingdom)
  • Stripe - Processes payments
  • Resend - Handles email communications

6.2 Data Storage: Your data is stored at rest in the United Kingdom and processed in the European Economic Area. A full list of our service providers and locations is set out in our Privacy Policy.

7. Termination

7.1 By You: You may terminate your account at any time through your account settings.

7.2 By Us: We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms
  • Abusive behaviour in discussions
  • Failure to pay subscription fees
  • Fraudulent activity

7.3 Effect of Termination: Upon termination:

  • Your access to paid features will end
  • Your personal account information will be deleted
  • Your discussion contributions will remain part of the collective dataset
  • You remain liable for any outstanding payments

8. Limitation of Liability

8.1 Service Provided "As Is": The platform is provided on an "as is" and "as available" basis. We make no warranties of any kind, whether express or implied.

8.2 Limitation: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Effective Date" at the top.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
